The Municipal Court handles violations of Fountain Municipal Code / Ordinances, Traffic and Criminal violations. The Fountain Police Department also writes citations into El Paso County Combined Courts. Carefully, review your ticket to ensure you are at the right courthouse.

COURT CLERK'S OFFICE:
The Clerks office is open from 8:00 A.M. to 5:00 P.M., Monday through Friday, except on all Federal and local holidays.. The main Phone Number is (719) 382-5561. The Clerks office can explain how the court works, reschedule hearings, answer questions on Court procedure and take payments for fines and costs. The Clerk's office cannot give legal advice, fill out forms or tell you what to say or write. A copy of all City of Fountain ordinances, the State of Colorado Model Traffic Code and a Schedule of Fines are located in the clerk's office and are available to the public. Our Court Office does not handle these types of cases: Marriage, Divorce, Restraining Order, Keep the Peace Order or Small Claims. TRAFFICCOURT SESSIONS:
Traffic Court is scheduled every Tuesday at 3:00 p.m. and closed on all Federal and Local holidays. The City Prosecutor does offer plea agreements / point reductions. The plea agreement / point reduction is available on your scheduled Court date after 9:00 a.m. for your review. You may accept the plea offer or continue your case for further proceedings. REGULARCOURT SESSIONS:
Municipal Court sessions are held on Thursdays except on Federal and Local holidays. Arraignments and Bond Appearances start at 5:00 p.m., Hearings start at 5:30 p.m., Pre-Trials start at 4:00 p.m., Court and Jury Trials start at 6:00 p.m.
COURT DATE CONTINUANCES
- Continuances must be requested in person, at the Court Office / Violations Bureau, Monday through Friday, 9:00am to 4:00pm before the scheduled Court Date.
- One continuance will be granted.
- If a defendant is under 18 years of age, they will need to appear with a parent or legal guardian.
- The parent of a juvenile may continue the case without the juvenile's presence when identification is provided.
- Attorneys requesting a continuance must file the appropriate paperwork with the Court.
COURT RECORD REQUEST
A minimum of three business days is required to process record request. Request must be picked up within 30 days or the record will be destroyed and a new request and payment will be necessary. Most court files are public record and may be viewed by anyone, however if you are not a party to the case the court is required to review the requested documents and remove (redact) protected information. Record request forms may be picked up and turned into the Court Office / Violation Bureau. This form is a public record and will be retained for 2 years. PROOF OF INSURANCE

If you are charged with failure to comply with compulsory insurance, you must provide proof to the Court on your scheduled appearance date.

A copy of your valid and current insurance card or policy is required. As well as, the insurance agent's name and telephone number.
WARRANTS
- Arrest / Bench warrants are issued for Failure to Appear or Failure to Comply with Court Orders or Conditions.
- When an arrest / bench warrant is issued by the Judge a warrant fee of $ 100.00 is imposed.
- Colorado law also requires this Court to notify the Department of Revenue, Motor Vehicle Division. The DMV will revoke a driver's license within any Interstate Compact States when an arrest / bench is issued.
- A bench warrant that is issued for a minor for any type of ticket will have their driver's license suspended.
WARRANT RESOLUTION:
In some cases, you can clear an arrest / bench warrant without being arrested by appearing at the Court Clerk's Office.
DRIVER'S LICENSE SUSPENSIONS
The State imposes a $30.00 fee in addition to any other warrant fees and costs that might apply.
- If a person is licensed to drive by another State, the Colorado Department of Revenue will initiate license revocation proceedings in your home State.
- If your license is revoked, additional fees will be incurred to reinstate your driver's license.
- The Court will clear a hold on a driver's licenses once all fines and costs are paid.
- The Court will give you a clearance letter to initiate the reinstatement process.
